Calvin Klein Holiday Competition Terms and Conditions

1.         The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

2.       The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

3.       Valid and eligible entries will be accepted during the Promotional Period.

4.       Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5.       Draw

i)         The draw will take place at PVH Brands Australia Pty Limited, 388 George Street, Sydney, NSW, Australia at 3:00 pm NZDT on 01/12/26 by random selection.

ii)        The first valid entry drawn will be the winner of the Draw prize specified in the Schedule above.

iii)       If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.

6.       All reasonable attempts will be made to contact each winner.

7.        A readily identifiable winner does not forfeit the prize merely by missing the claim deadline. A substitute winner may be drawn only in the circumstances set out in the Schedule. Where a winner is readily identifiable, the prize will be transferred within 28 days after the relevant draw.

8.       A substitute prize must be of equal or greater value and agreed with the winner in writing. If the original prize becomes unavailable for reasons beyond the Promoter's reasonable control and reasonable attempts to agree with the winner are unsuccessful, the Promoter may substitute a prize of equal or greater value without that agreement, subject to applicable law.

9.       No entry fee is charged by the Promoter to enter the Promotion. VIP membership is free and no purchase is required. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.

10.    If there is a dispute as to the identity of an entrant or winner, the Promoter may request reasonable evidence to verify identity and will consider any information provided before making a decision.

11.       The Promoter collects entrants' personal information to administer the Promotion, verify eligibility, contact the winner and deliver the prize, and to administer VIP membership where applicable. Marketing communications will be sent only in accordance with the entrant's separate marketing consent; declining or withdrawing consent does not affect a valid competition entry or prize. The Promoter may disclose information to contractors, service providers and prize suppliers assisting with these purposes, and to regulators where required by law. If information reasonably required for entry or prize delivery is withheld, the entrant may be unable to enter or receive the prize. The collection notice on the entry form and the privacy policy at [https://www.calvinklein.co.nz/privacy-policy] explain how to contact the Promoter, access or correct personal information and make a privacy complaint, and how complaints are handled. Overseas disclosures and the countries concerned, where practicable to specify, are described in that notice and policy.

12.     For the purposes of public statements and advertisements, the Promoter may only publish the winner's First name, surname, state/ territory or region of residence. The winner details and prize will be published at https://www.calvinklein.co.nz/calvin-klein-holiday-competition-terms from 02/12/26 for at least 28 days. Results of any further draw will be published on that page within one business day and remain available for at least 28 days.

13.     Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the NZ Fair Trading Act 1986 and Consumer Guarantees Act 1993.

14.     If circumstances beyond the Promoter's reasonable control materially affect the fair conduct of the Promotion, the Promoter may take only the steps reasonably necessary to address that effect, subject to applicable law and any required prior regulatory approval. Entrants will be told of any material change.

15.     The Promoter may reasonably verify an entrant's identity, age, residence and compliance with the entry requirements. An entrant will have a reasonable opportunity to provide requested evidence or clarify an apparent error. An entry may be disqualified where it is ineligible, fraudulent or materially breaches these Conditions of Entry. Automated or repeated entries exceeding the entry limit are not permitted.

16.     The Promoter will consider and respond reasonably to disputes about the conduct of the Promotion. Nothing in these Conditions of Entry limits an entrant's right to seek a remedy available under law.

17.      Any photographs, interviews or other publicity require the winner's separate, voluntary consent. Refusal does not affect entry or entitlement to the prize.

18.     Unless otherwise specified, the prize is one gift card for one winner and cannot be divided between winners.

19.     The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regard to the tax implications relating to the prize or acceptance of the prize.

20.   Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
